In doing so, the Company will ensure compliance by its staff to the strictest standards of security and confidentiality in respect of all personal information and data submitted by users via www.wordpress-802971-2794410.cloudwaysapps.com, its sub-domains, and any other websites, media platforms, or applications including the Mobile Application operated by the Company (hereinafter collectively referred to as the “Channels”) and the Company will not release such information to anyone without the prior consent of the relevant user(s) of the Channels (whether registered or not) (the “User” or the “Users”), except to the authorized persons listed in Clause 4.1 below.

1. Collection of Personal Data

1.1 Ohmyhome may collect the following information (“Personal Data”) from you or your authorized representatives, from third parties, or from publicly available sources through OMH in the following ways:
a. The information you provide Ohmyhome about yourself by filling in forms or questionnaires on OMH or by corresponding with Ohmyhome;

b. Information that you provide by filling in forms on our site www.wordpress-802971-2794410.cloudwaysapps.com (“our site”). This includes information provided at the time of registering to use our site, subscribing to our service, posting material or requesting further services. We may also ask you for information at other times, for example in connection with a promotion or when you report a problem with our site;

c. The information you provide Ohmyhome through registration of an OMH Account or Listing;

d. The information you provide Ohmyhome using credentials from third party platforms and applications (e.g. Facebook, Google). You authorize us to collect your authentication information, such as your username and encrypted access credentials. We may collect other information available on or through your third-party application account, including but not limited to your profile picture, country, hometown, email address, date of birth, gender, friends” names and profile pictures and networks;

e. Any Personal Data relating to a third party (e.g. information of your spouse, children, parents etc.) that you provide to us on the basis that you represent that, by submitting such information to us, you have obtained the consent of the third party to provide us with their Personal Data;

f. Your location information is determined by GPS technology. You can withdraw consent at any time by not advancing further in the App, or by deactivating the service on your mobile device or computer;

g. Your information that Ohmyhome receives from other third party sources; and

h. Where you contact us, a record of that correspondence may be kept for our internal training and quality-assurance purposes.

i. Only duly authorized staff of the Company will be permitted to access the User’s personal information and data, and the Company shall not release such personal information and data to any third parties save and except for the circumstances listed out under the Clause 4.1.

2. Purposes of the Collection Personal Data

2.1 In the course of using the Channels, Users may disclose or be asked to provide personal information and/or data. In order to benefit from and enjoy the various services offered by the Channels, it may be necessary for Users to provide the Company with their personal information and/or data. Although Users are not obliged to provide the information and/or data as requested on the Channels, the Company will not be able to render certain services on the Channels in the event that Users fail to do so.

2.2 Generally, we may use and/or disclose your Personal Data to our affiliates and subsidiaries, and their officers, directors, employees, business partners and agents for the following purposes, where permitted by the Act:
a. To improve your browsing and user experience by personalizing OMH;

b. To enable your use of the Services;

c. Where you have enabled integration with third party platforms and applications (e.g. Facebook, Google), we may use your public information to promote the Services. Your information may be used to notify others including within OMH, via email and through the third-party platforms and applications, about your use of the Services;

d. To provide to you the Services you have specifically requested;

e. To respond to your queries and requests and acting on complaints, suggestions, and/or submission of form(s) on OMH;

f. To manage our infrastructure and business operations and comply with internal policies and procedures;

g. To verify your identity, Listings, or any submitted Content;

h. To match any Personal Data held which relates to you for any of the purposes listed herein;

i. To provide media announcement and responses;

j. To perform analytics and tracking, and conducting market research;

k. To monitor or record phone calls and customer-facing interactions for quality assurance, employee training and performance evaluation and identity verification purposes;

l. To conduct audits, reviews, and analysis of our internal processes, action planning, and managing commercial risk;

m. To comply with any applicable rules, laws and regulations, codes of practice or guidelines, or to assist in law enforcement and investigations by relevant authorities; and

n. Purposes which are reasonably related to the aforesaid.

2.3 The Company strives to collect only personal data which is necessary and adequate but not excessive in relation to the purposes set out above.

2.4 If the User is under the age of eighteen (18), the Company strongly recommends that he or she seeks prior consent from a parent or guardian, who may contact the responsible personnel of the Company at help@omh.sg to register the User as member of the Channels.

2.5 If the Company requires the User’s personal data for a purpose other than those set out hereinabove, the Company may request the User’s prescribed consent to the same. If the User is a minor, the prescribed consent should be given by his or her parent or guardian.

3. Uses made of the information

3.1 The purposes for which information may be used by us in and outside Singapore include:
a. ensuring that content from our site is presented in the most effective manner for you and for your computer;

b. providing you with alerts, newsletter, education materials or information that you requested or signed up to;

c. carrying out our obligations arising from any contracts entered into between you and us;

d. allowing you to participate in interactive features of our service, when you choose to do so;

e. designing and conducting surveys/questionnaires for client profiling/segmentation, statistical analysis, improving and furthering the provision our products and services;

f. complying with laws and regulations applicable to us or any of our affiliates in or outside Singapore;

a. your name, contact details (including address, contact number, email address), products and services information, transaction pattern and behaviour, background and demographic data held by us from time to time may be used by us in direct marketing;

b. the following classes of services, products and subjects may be marketed in direct marketing:
(i) services and products related to our site and/or our affiliates (including marketing affiliates programs we are a part of);

(ii) reward, loyalty or privileges programs, promotional offers and related services; and

(iii) invitations to events such as seminars/webinars/tele-seminars, conferences, live programs or events.

4.1 We will keep the personal data we hold confidential but may provide information to:

a. personnel, agents, advisers, auditors, contractors, financial institutions, and service providers in connection with our operations or services;

b. our overseas offices, affiliates, business partners and counterparts (if any);

c. persons under a duty of confidentiality to us;

d. persons to whom we are required to make disclosure under applicable laws and regulations in or outside Singapore; or

e. actual or proposed transferees or participants of our services in or outside Singapore.

4.2 The Company agrees to take all practicable steps to keep all personal information and data of Users confidential and/or undisclosed, subject to the following conditions.

4.3 Generally speaking, the Company will only disclose and/or transfer the User’s personal information and/or data to the Company’s personnel and staff for the purpose of providing services to the User. However, the Company may disclose and/or transfer such information and/or data to third parties under the following circumstances:
a. where the information and/or data is disclosed and/or transferred to any third-party suppliers or external service providers who have been duly authorized by the Company to use such information and/or data and who will facilitate the services on the Channels, under a duty of confidentiality;

b. where the information and/or data is disclosed and/or transferred to any agents or associates of the Company who have been duly authorized by the Company to use such information and/or data;

Most websites like ours use cookies to enhance your online experience. Ohmyhome uses cookies on OMH for the follow purposes:
a. To provide you with a better user experience while using OMH, as well as improve OMH. This enables certain features and functions on our website, such as remembering your OMH Account information, or browsing preferences for the Services;

b. To improve the efficiency of OMH;

c. To administer services to you and to advertisers;

d. To establish usage statistics; and

e. To allow business partners to collect information about your online activities through the cookies and other Technology when you use OMH and the Services. The information gathered by these business partners are personally non-identifiable information which is used to make predictions about your interests, characteristics, or preferences and to personalise advertising you may encounter on OMH and on other websites.

5.12 You may disable the collection of cookies associated with the above by changing the setting on your browser. You acknowledge that this may materially affect your usage of OMH.

5.14 OMH may, from time to time, contain links to and from websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites and any services that may be accessible through them have their own privacy policies and that Ohmyhome does not accept any responsibility or liability for any policies or for any personal data that may be collected through these websites or services, such as your contact and location data. Please check these policies before submitting any personal data to these websites or using these services.

5.15 Parties to these Terms shall comply with the Act and all other successor legislation and regulation in the performance of the obligations set out under these Terms.

6. Subscription to Newsletter, Promotional Materials, or Marketing Materials

6.1 The Company may from time to time send to members and Users of the Channels newsletters, promotional materials, and marketing materials based on the personal information and data that they have provided to the Company. The Company may use the User’s data in direct marketing and the Company requires the User’s consent (which includes an indication of no objection) for that purpose. In this connection, please note that:
a. the name, login ID and password, contact details, age, sex, date of birth, country of residence, nationality, education level, and work experience of the User held by the Company from time to time may be used by the Company and/or its authorized personnel or staff in direct marketing;

b. the following classes of services, products, and subjects may be marketed:

c. products and services offered by the Company and its advertisers (the names of such entities can be found in the relevant advertisements and/or promotional or marketing materials for the relevant products and services, as the case may be); or

d. donations and contributions for charitable and/or non-profit making purposes;

e. the above products, services, and subjects may be provided or (in the case of donations and contributions) solicited by the Company and/or:

f. third party service providers providing the products, services, and subjects listed in Clause 6.1(ii) above; and

g. charitable or non-profit marking organizations;

h. in addition to marketing the above services, products, and subjects itself, the Company also intends to provide the data described in Clause 6.1(i) above to all or any of the persons described in Clause 6.1(ii)(b) above for use by them in marketing those services, products, and subjects, and the Company requires the User’s written consent (which includes an indication of no objection) for that purpose; and

i. the Company may receive money or other property in return for providing the data to the other persons in Clause 6.1(ii)(b) above and, when requesting the User’s written consent as described in Clause 6.1 above, the Company will inform the User if the Company receives any money or other property in return for providing the data to the other persons.

6.2 Suitable measures are implemented to make available to such members the options to opt out of receiving such materials. In this regard, Users may choose to sign up or unsubscribe for such materials by logging into the registration or user account maintenance webpage, or by clicking on the automatic link appearing in each newsletter/message, or by contacting the Customer Service Representative of the Company at +65 6886 9009 or email to help@omh.sg.

7. Access

7.1 Any User is entitled to request access to or make amendments to his or her own personal information and data kept with the Company by contacting the Customer Service Representative of the Company at +65 6886 9009 or email to help@omh.sg.

7.2 In the event that a User wishes to access or amend his or her personal information and data, the Company may request him or her to provide personal details in order to verify and confirm his or her identity. An identity card number or passport number or company registration number cannot be amended unless such data is proved to be inaccurate. The Company is required to respond to a User’s request within three (3) days of his or her request and will endeavour to do so wherever possible.

8. Google Analytics

8.1 Google Analytics Advertising Features (“Features”) are implemented on the Channels. The Features which the Company has implemented are based on Google Analytics Demographics and Interest Reporting.

8.2 Google Analytics is a web analysis service provided by Google which utilises the data collected to track and examine the use of the Channels to prepare reports on the Users’ activities and share them with other Google services. Google may use the data collected to contextualise and personalise the marketing materials of its own advertising network.

9. Withdrawal of Consent

13.1 You may withdraw consent in respect of any collection, use, or disclosure of your Personal Data or make corrections to your Personal Data records by notifying Ohmyhome”s Personal Data Protection Officer in accordance with Privacy Policy Clause 14.2.

13.2 Where your Personal Data has been received from third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers and credit reference agencies), you should contact such party directly to make any queries, feedback, and access and correction requests to Ohmyhome on your behalf.

13.3 Please note that if you withdraw your consent to any or all use of your Personal Data, depending on the nature of your request, Ohmyhome may not be in a position to continue to provide its products or services to you or administer any contractual relationship in place, and this may also result in the termination of any agreements with Ohmyhome and your being in breach of your contractual obligations or undertakings, and Ohmyhome”s legal rights and remedies in such event are expressly reserved.

10. Security

10.1 All information you provide to us is stored on our secure servers. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.
10.2 Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk and you agree not to hold us responsible for any breach of security while accessing the internet that is out of our control. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.
10.3 The security of Users’ personal information and data is important to the Company. The Company will always strive to ensure that Users’ personal information and data is protected against unauthorised access. 10.4 All personal data and information provided by Users is only accessible by the authorised personnel of the Company or its authorised third parties, and such personnel shall be instructed to observe the terms of this Privacy Policy when accessing such personal information and data. Users may rest assured that their personal information and data will only be kept for as long as is necessary to fulfill the purpose for which it is collected. Registered Users should safeguard their unique usernames and passwords by keeping them secret and confidential and by never sharing these details with anyone.

10.5 The Company uses third-party payment gateway service providers to facilitate electronic transactions on the Channels. Regarding sensitive information provided by Users, such as credit card numbers for completing any electronic transactions, the web browser and third-party payment gateway communicate such information using secure socket layer technology (SSL).

10.6 The Company follows generally accepted industry standards to protect the personal information and data submitted by Users to the Channels, both during transmission and once the Company receives it. However, no method of transmission over the Internet, or method of electronic storage, is completely secure. Therefore, while the Company strives to protect Users’ personal information and data against unauthorised access, the Company cannot guarantee its absolute security.

11. TERMINATION

11.1 We may terminate your OMH Account immediately without prior notice under certain circumstances at our own discretion, such circumstances shall include (but is not limited to):
a. breaches or violations of the Terms or other incorporated documents, guidelines or rules;

b. request by law enforcement or other government agencies;

c. self-initiated account deletions;

d. infringement of intellectual property rights of others;

e. discontinuance or material modification to OMH”s Services, or part thereof;

f. unexpected technical or security issues or problems; or

g. extended periods of inactivity.

11.2 Termination of your OMH Account shall result in:
a. removal of access to and barring of further use to all of OMH”s Services that are associated with such your OMH Account; and

b. deletion of your password and all related information, files and content associated with or inside your OMH Account (or part thereof).


11.3 Termination of your OMH Account shall be without prejudice to any other rights or remedies we may be entitled to under the Terms, at law or in equity and shall not affect any accrued rights or liabilities nor the coming into or continuance in force of any provision which is expressly or by implication intended to come into or continue in force on or after such termination.

11.4 The Terms of Service will continue to apply until terminated by either you or us as follows.

11.5 You may end your agreement with us at any time for any reason by deactivating your accounts and discontinuing your use of the Services. You do not need to specifically inform us when you stop using the Services.

11.6 We may suspend or terminate your accounts or cease providing you with all or part of the Services at any time for any reason, including, but not limited to, if we reasonably believe:
a. you have violated these Terms of Service or

b. you create risk or possible legal exposure for us; or

c. our provision of the Services to you is no longer commercially viable. We will make reasonable efforts to notify you by the email address associated with your account or the next time you attempt to access your account.

11.7 In all such cases, any provision of these Terms of Service that expressly or by implication is intended to come into or continue in force on or after termination of this agreement shall remain in full force and effect.

12. GENERAL TERMS

12.1 Death (for individuals only)

Any OMH Account that you may have with us is not transferrable and any rights to such account will terminate upon your death. Upon receipt of a copy of your death certificate, your account will be terminated and all content that you have generated in your account will be permanently deleted.

12.2 Waiver

Ohmyhome”s failure to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. No waiver by Ohmyhome of any of these Terms shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

No failure or delay by a party to exercise any right or remedy provided under this agreement or by law shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall prevent or restrict the further exercise of that or any other right or remedy.

12.3 Severance

If any provision or part-provision of the Terms is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this Clause shall not affect the validity and enforceability of the rest of this agreement.

The illegality, invalidity or unenforceability of any provision of these Terms of Service under the law of any jurisdiction shall not affect its legality, validity or enforceability under the laws of any other jurisdiction nor the legality, validity or enforceability of any other provision.

12.4 Indemnity

You agree to defend, indemnify and hold us harmless from and against all liabilities, damages, claims, actions, costs and expenses (including without limitation legal fees), in connection with or arising from your breach of any of these Terms of Service and/or your use of the website. We may, if necessary, participate in the defence of any claim or action and any negotiations for settlement. No settlement which may adversely affect our rights or obligations shall be made without our prior written approval. We reserve the right, at our own expense and on notice to you, to assume exclusive defence and control of any claim or action.

12.5 Several users

If there are two or more persons adhering to these Terms of Service as user, their liability under the Terms of Service is joint and several, and their rights are joint.

12.6 Data transfers

We may hold your data on servers in Singapore and any other territories as we see fit from time to time. We may also transfer your data to our overseas offices or to any people listed at Clause 4.1 a. above, who may be located in or outside of Singapore.

12.7 No Partnership or Agency

Nothing in these Terms is intended to, or shall be deemed to, establish any partnership or joint venture between the parties, nor constitute either party the agent of the other for any purpose. Neither party shall have authority to act as agent for, or to bind, the other party in any way.

12.8 Third Party Rights

A person who is not a party to these Terms shall not have any rights to enforce its terms.

12.9 Languages

This agreement is drafted in the English language. If this agreement is translated into any other language, the English language version shall prevail.

12.10 Governing Law & Jurisdiction

The Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, and any claims or disputes of whatever nature shall be subject to the exclusive jurisdiction of the courts of the Republic of Singapore.


13. Your consent and rights

13.1 By using our service, making an application or visiting our website, you consent to the collection and use of your information and other activities as outlined in this policy.

13.2 Under the Personal Data Protection Act (the “PDPA”), individuals have the right:
a. to check whether we hold personal data about you and to access such data;

b. to require us to correct as soon as reasonably practicable any data relating to you that is inaccurate;

c. to ascertain our policies and practices in relation to personal data and the kind of personal data held by us; and

d. to object to the use of your personal data for marketing purposes and we shall not use your personal data for marketing purposes after you communicate your objection to us.

13.3 You may exercise opt-out right by notifying us if you wish to object to the use of your personal data for direct marketing purposes. Please send requests for such objections, access to data, correction of data, information regarding policies and practices and kinds of data held, questions or complaints to:

13.4 In accordance with the terms of the PDPA, we have the right to and may charge a minimum fee for processing any data access request.

14. NOTICES

14.1 Any notices or other communications permitted or required hereunder, including those regarding modifications to these Terms, shall be in writing and made by Ohmyhome:
a. via a posting circulated through the App or Website; and/or

b. via the email address you provided when registering for your OMH Account (where applicable).

14.2 All notices to Ohmyhome pursuant to these Terms shall be given:
a. via email to help@omh.sg; or

b. via the OMH hotline at +65 6886 9009;

14.3 For notices made by email, the date of receipt will be deemed the date on which such notice is successfully sent.

14.4 The provisions of this Clause shall not apply to the service of any proceedings or other documents in any legal action.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE APP, WEBSITE, OR SERVICES PROVIDED FROM THE APP OR WEBSITE.

This document sets out the terms and Conditions (“Terms”) on which Ohmyhome Pte Ltd (UEN No.: 201525768E) of 11 Lorong 3 Toa Payoh, #04-17 Jackson Square, Singapore 319579 (“Ohmyhome”, “we” or “us”) operates and provides customers with access and use of the Ohmyhome mobile application software program (“App”) and the www.wordpress-802971-2794410.cloudwaysapps.com website (“Website”). The term “you” refers to the user or viewer of the App and/or Website.
The App and Website are hereinafter collectively referred to as “OMH”.

KEY TERMS & DEFINITIONS

“Content” means text, graphics, images, music, software (excluding the App), audio, video, information, data, or other materials uploaded, downloaded or appearing on the Services.
“Guest” means a user who does not create an account with OMH and is not a Member.
“Elite Member” means a Member who may create and browse a Listing via OMH.
“Listing” means descriptions of residential, commercial, lots, or other real estate properties that are listed in OMH as available for sale or rental via OMH. Creation of listings may be uploaded by an Elite Member or OMH administrator.
“Member” means a user who completes the account registration process in accordance with Clause 6 below.
“Member Content” means all Content that a Member posts, uploads, publishes, submits, or includes in their Listing or Member profile to Ohmyhome or made available through OMH.
“Ohmyhome Content” means all Content that Ohmyhome makes available through OMH to Guests and Members including any content licensed from a third party, but excluding Member Content.
“Services” means the features available under the App and Website including browsing, posting, managing, selling Listings and financial budgeting.
A reference to “person” shall include an individual, corporation, company, partnership, firm, trustee, trust, executor, administrator or other legal personal representative, unincorporated association, joint venture, syndicate or other business enterprise, any governmental, administrative or regulatory authority or agency, and their respective successors, legal personal representatives and assigns, as the case may be, and pronouns shall have a similarly extended meaning.

ACCEPTANCE OF TERMS

By using and accessing OMH, you confirm and acknowledge that you have read, understood and agreed to the Terms which will bind you, whether you are a Guest or a Member. The Terms include our Privacy Policy.
If you accept or agree to these Terms on behalf of a company or other legal entity, you represent and warrant that you have the full capacity and authority to enter into this agreement on behalf of the company or other legal entity, and in such event, “you” and “your” will refer and apply to that company or other legal entity.
By using and accessing OMH, you acknowledge and agree that internet transmissions are never completely private or secure. You understand that any information submitted via OMH may be read or intercepted by others, even if there is a special notice that a particular transmission is encrypted.
We may amend these Terms at any time and without prior notice or liability to you. Such amendments will be effective immediately and shall apply to any information you provide, or your use of the Services. Your use and access of OMH after the amendments to these Terms will constitute your acceptance to the terms and conditions, as modified.
OMH may contain links to other third-party websites. These websites are not under Ohmyhome’s control, and we are not responsible for and do not endorse their content or their privacy policies (if any). Your access and use of these third-party websites may constitute acceptance of their terms of service, which are exclusive to these Terms.
By accessing, downloading or using Google Maps in OMH, you agree to be bound by any applicable terms and conditions of Google Maps in connection with its use.
In the event that you access, download or use the App through any application, electronic store or database, you also agree to be bound by the terms of service of such application, electronic store or database.

CHANGES TO OUR SERVICES

The Services that we provide are always evolving and the form and nature of the Services that we provide may change from time to time without prior notice to you. In addition, we may stop (permanently or temporarily) providing the Services (or any features within the Services) to you or to users generally and not be able to provide you with prior notice.
We also retain the right to create limits on use and storage at our sole discretion at any time and without prior notice to you.
We make no representations, warranties or guarantees, whether expressed or implied, that our Services or any content on our site is accurate, complete, up-to-date or free from errors or omissions.

ACCESSING OUR SERVICES

Our Services are made available free of charge for one year. Succeeding years of membership will constitute equivalent subscription rates for full access to the platform’s features.
We do not guarantee that our Services, or any content, will always be available or be uninterrupted. Access to our Services is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our Services without notice. We will not be liable to you if for any reason our Services are unavailable at any time or for any period.
You are responsible for making all arrangements necessary for you to have access to our Services.
You are also responsible for ensuring that all persons who access our Services through your internet connection are aware of these Terms of Service and other applicable terms and conditions, and that they comply with them.

GRANT AND SCOPE OF LICENSE IN RESPECT OF THE APP

In consideration of you agreeing to abide by the Terms and in respect of your use of the App, we grant you a non-transferable, non-exclusive license to download and install a copy of the App on each mobile device that you own or control and to run such copy of the App solely for your personal use.
Subject to your compliance with these Terms, we grant you a non-exclusive and non-transferable license to:
access and view any Ohmyhome Content solely for your personal and non-commercial purposes and
access and view any Member Content to which you are permitted access, solely for your personal and non-commercial purposes. You have no right to sublicense the license rights granted in this section.
Except as expressly set out in the Terms or as permitted by any local law, you agree:
not to rent, lease, sub-license, loan, translate, merge, adapt, vary or modify the App;
not to make alterations to, or modifications of, the whole or any part of the App, or permit the App or any part of it to be combined with, or become incorporated in, any other programs;
not to disassemble, decompile, reverse-engineer or create derivative works based on the whole or any part of the App or attempt to do any such thing except to the extent that such actions cannot be prohibited because they are essential for the purpose of achieving inter-operability of the App with another software program, and provided that the information obtained by you during such activities:
is used only for the purpose of achieving inter-operability of the App with another software program;
is not unnecessarily disclosed or communicated without our prior written consent to any third party; and
is not used to create any software that is substantially similar to the App;
to exercise best endeavours to keep all copies of the App secure and to maintain accurate and up-to-date records of the number and locations of all copies of the App;
not to provide or otherwise make available the App in whole or in part (including object and source code) in any form to any person without prior written consent from us; and
to comply with all applicable laws and regulations relating to the technology used or supported by OMH (“Technology”) for the time being in force.
(Collectively, “License Restrictions”)

GENERAL USE INSTRUCTIONS

You agree that you shall not:
use OMH or any Service in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with the Terms, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, including viruses, or harmful data, into the App, any Service or any operating system;
infringe Ohmyhome’s intellectual property rights or those of any third party in relation to your use of OMH, including the submission of Member Content;
transmit any material that is threatening, infringing, defamatory, offensive, illegal or otherwise objectionable in relation to your use of OMH or any Service;
use OMH or any Service in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users; and
collect or harvest any information or data from OMH or OMH’s systems or attempt to decipher any transmissions to or from the servers running OMH.
(Collectively, “User Restrictions”)

ACCOUNT REGISTRATION

In order to access all of the Services and Member Content, you must register to create an account with Ohmyhome Elite Network (“OMH Account”) to become a Member. A Guest may only access Ohmyhome Elite Network Content and browse through the Listings but will not be able to contact Homeowners for viewings or post a Listing.
You are not allowed to set up multiple OMH Accounts. If we have reason to believe that you have done so, we reserve the right to take all steps in accordance with Clause 6.10.
In registering with Ohmyhome to become a Member, you represent, warrant and undertake that:
you are at least 21 years of age;
you are using your real identity;
the information and personal particulars you have provided to Ohmyhome are true, accurate, complete, and current information; and
you will maintain and promptly update such information and personal particulars provided and ensure that such information is kept accurate, complete, and current.
Users below the age of 21 years are not eligible to use OMH or provide any information or personal particulars to OMH unsupervised. If you are below 21 years of age, you may use OMH and/or provide any information or personal particulars on OMH only after you have obtained consent from your parents/legal guardian or if you are under the supervision of your parent/legal guardian.
In the event that we have given you (or where you have chosen) a password which enables you to access certain parts of OMH, you acknowledge that you are fully responsible for maintaining the confidentiality of your password, and all activities occurring under your OMH Account.
You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. We encourage you to use “strong” passwords (passwords that use a combination of upper and lower case letters, numbers and symbols) with your account. You must treat such information as confidential. You must not disclose it to any third party. Ohmyhome Pte Ltd cannot and will not be liable for any loss or damage arising from your failure to comply with the above.
We have the right to disable any password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion, you have failed to comply with any of the provisions of these Terms of Service.
You agree to notify us of any breach of security of your password at help@omh.sg.
We do not verify the accuracy, correctness or completeness, or edit and modify any Member Content or any Content created, used, or submitted by you on OMH to determine whether it may result in any liability to any third party. You hereby warrant that you have the right to use all such Content and use of such Content does not infringe on any third party’s intellectual property rights.
Notwithstanding Clause 6.9 above, we reserve the right to conduct verification and security procedures in respect of all information and Content provided by you to us. If we have reason to believe that any information, personal particulars and/or Content provided by you in registration or through the Services breaches or is likely to breach any of the Terms, we reserve the right to limit, suspend, deactivate, or terminate your Listings or your OMH Account. Any reinstatement of your Listings or your OMH Account shall be in our sole discretion. If you have reason to believe that OMH’s suspension, deactivation or termination of your Listings or your OMH Account is wrong, you may contact us (pursuant to Privacy Policy Clause 14 below) providing sufficient details of your complaint (the “Complaint”) as follows:
your particulars, including your full name, address, telephone number, and email address such that you may be contacted about your notice;
a description and particulars of the complaint; and
a signed statement that the above information is accurate.
Ohmyhome’s verification and security procedures do not constitute an endorsement, certification, or guarantee of any Member, Member’s Content, or Listing, including of the Member’s identity and whether the Member is trustworthy, safe, or suitable.
Any references in OMH to a Member or a Listing being “verified” only indicate that the Member has completed a relevant verification and security procedure.
We will not be liable for any loss or damages from your failure to comply with any obligations set out in this Clause 6.

WARRANTIES AND DISCLAIMERS

Please read this section carefully since it limits the liability of Ohmyhome Pte Ltd and its parents, subsidiaries, affiliates, related companies, officers, directors, employees, agents, representatives, partners, and licensors (collectively, the “Entities of Ohmyhome Pte Ltd”). Each of the subsections below only applies up to the maximum extent permitted under applicable law.
Your use of OMH is at your sole risk. To the maximum extent permissible by law, we disclaim any and all warranties of any kind, whether express or implied in connection with OMH and the Services.
We make no warranty that:
OMH and the Services will be fit for any particular purpose;
OMH and the Services will meet your requirements; or
the Listings will be accurate.
Access to OMH financial budgeting Services assume the accuracy of the user’s inputs and are provided on a general basis for information purposes. The calculators is for your convenience only and any person acting upon or in reliance of this information does so entirely at their own risk. No warranty whatsoever is given and no liability is accepted by the company behind this calculator for any loss arising directly or indirectly as a result of any action or omission made in reliance of any information presented herein at any time.
Access to OMH and the Services is reliant on third party service providers, including but not limited to network providers, data centers, software and software platform developers, web platforms and telecommunication providers. Ohmyhome makes no warranty that access to OMH will be uninterrupted, timely, secure, error-free, or available at any time or all times.
You are solely responsible for all your communications and interactions with other users of the Website, App or Services and with other persons with whom you communicate or interact as a result of your use of the Website, App or Services, including but not limited to any Members.
We do not endorse and are not responsible for any messages, views, opinions, research and recommendations of individuals, users and organizations of deemed interest or advocate any patronage of any particular service provider, course of treatment or commercial dealings in any securities, investments or classes of securities or investments nor does the inclusion of any link to other third-party websites and/or service providers imply any form of endorsement by us.
Our website may contain links to other sites (the “Linked Sites”). We are not responsible for the privacy policies or practices of such other Linked Sites. We encourage our users to be aware when leaving our website to read the privacy policies or statements of each Linked Site that collects your personal data. You agree to waive any claim against us with respect to the Linked Sites.
By making available any information and data on OMH, including facts, views, opinions, and recommendations of individuals and organizations of deemed interest, Ohmyhome is not giving or purporting to give or representing or holding themselves out as giving financial, tax, legal and otherwise professional advice. You shall always seek the relevant professional advice before otherwise making any such decisions.
By using and accessing OMH, you acknowledge and agree that Ohmyhome Content may only be used for your personal use, and not for publication, distribution, transmission, retransmission, redistribution, broadcast, reproduction, or circulation to someone else in the same company or organization, and not for posting to other websites, forums, newsgroups, mailing lists, bulletin boards, or other services operated by other websites.
OMH is an online platform through which Elite Members create Listings for the sale or rental of their Clients’ residential properties or browse Listings to present to their Clients and Members may learn about and make enquiries directly with the OMH. You understand and agree that:
Ohmyhome is not a party to any agreements entered into between the Elite Member and buyer or tenant;
Ohmyhome has no control over the conduct of other users of the App, Website, and Services and may only take steps pursuant to Clause 6.10 in its own discretion;
Ohmyhome has no control over the Listings; and
Ohmyhome disclaims all liability in this regard to the maximum extent permitted by law.

INDEMNITIES

You agree and undertake to hold completely harmless and keep us and our affiliates, officers, agents or other partners, and employees (collectively, the “Indemnified Parties”), fully and effectively indemnified against any and all losses, costs, damages, claims, demands, actions, proceedings, liabilities and expenses whatsoever (including but not limited to all legal costs or attorney’s fees on a full indemnity basis) that may be made against or suffered or incurred by us or any of the Indemnified Parties arising out of or in connection with:
your access to or use of the OMH, the Services, or Content;
your Member Content;
your interaction with any Member;
your creation of a Listing; and/or
your violation of these Terms.

LIMITATION OF LIABILITY

You agree that notwithstanding anything in these Terms, we shall not be liable to you, in contract, tort (including negligence) or otherwise howsoever, and whatsoever the cause thereof for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data or other intangible losses arising out of or in connection with your use or access of OMH and the Services.
In no event, will Ohmyhome Pte Ltd be liable for any direct, indirect, special, punitive, exemplary, or consequential losses or damages of whatsoever kind arising out of your use of or access to the App, including loss of profit or the like whether or not in the contemplation of the parties or whether based on breach of contract, tort (including negligence), product liability, or otherwise.
Your access to and use of our services is at your sole risk and is provided “AS IS”, “AS AVAILABLE”. The services are for your personal use only and the entities of Ohmyhome Pte Ltd makes no representation or warranty of any kind, expression or implied, including, without limitations, any warranties on merchantability or fitness for any particular purpose or non-infringement.
The entire liability or the entities of Ohmyhome Pte Ltd entities and your exclusive remedy with respect to the services or otherwise, is re-performance of defective services. In jurisdictions, which do not allow the exclusion or limitation of certain types of liability, our liability will be limited to the maximum extent permitted by the law. We do not endorse, warrant or guarantee any material, product or service offered through us or our services. We are not and will not be a party to any transactions between you and any third party.
In no event, shall the aggregate liability of the entities of Ohmyhome Pte Ltd exceed one hundred Singapore dollars. (S$100).
The Entities of Ohmyhome Pte Ltd shall not guarantee or assume any responsibility that:
the information presented in our Services is accurate, adequate, current or reliable, or may be used for any purpose other than for general reference;
the information presented in our Services is free of defect, error, omission, virus or anything which may change, erase, add to or damage your software, data or equipment;
messages sent through the internet including in connection with the services will be free from interception, corruption, error, delay or loss;
access to the Services will be available or be uninterrupted;
use of the Services will achieve any particular result; or
defects in the Services will be corrected.
Without limiting the generality of the foregoing, in no event will the Entities of Ohmyhome Pte Ltd be liable to you or any other person for any direct, indirect, incidental, special, punitive or consequential loss or damages, including any loss of business, profit, goodwill or reputation arising out of any use, or inability to use, the information or the services, even if any of the Entities of Ohmyhome Pte Ltd has been advised of the possibility of such loss or damages.
You will exercise and rely solely on your own skill and judgment in your use and interpretation of the information and use of the services. You are responsible to ensure that your use of the information and the Services complies with all applicable legal requirements.
Without prejudice to the foregoing, if your use of the Services does not proceed satisfactorily and/or where applicable you do not receive appropriate responses to such use from us, as set out in these Terms of Service or otherwise, you are advised to contact us at +65 6886 9009. No such lack of response shall be deemed to constitute any acquiescence or waiver.
The limitation of liability contained in these Terms of Service will apply to the fullest extent permitted by applicable laws.

INTELLECTUAL PROPERTY RIGHTS

You acknowledge that all intellectual property rights (“IP”) in OMH and the Technology anywhere in the world belong to Ohmyhome and their licensors, that rights in the App are licensed (not sold) to you, and that you have no rights in, or to, the OMH or the Technology other than the right to use each of them in accordance with the terms of these Terms.
You acknowledge that you have no right to have access to the App in source-code form.
You hereby grant to Ohmyhome and its affiliates a worldwide, irrevocable, non-exclusive, transferable license, with the right to sublicense, use, view, copy, adapt, modify, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, access, view, and otherwise exploit such Member Content either on, though, by means of, to promote, or market OMH. Ohmyhome does not claim any ownership rights in any such Member Content and nothing in these Terms will be deemed to restrict any rights that you may have to use and exploit any such Member Content.
Ohmyhome may invite you to submit reviews and/or testimonials in relation to the Ohmyhome Services provided. By providing such reviews and/or testimonials, you consent and grant Ohmyhome and its affiliates a non-exclusive, royalty-free, perpetual, transferable, irrevocable and fully sub-licensable right to
use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from and publicly display the reviews and/or testimonials throughout the world in any media, now known or hereafter devised, for the purposes of promote, or market OMH; and
use the name that you submit in connection with such reviews and/or testimonials. You acknowledge that Ohmyhome may choose to provide attribution of your comments or reviews at its discretion. You further grant Ohmyhome the right to pursue at law any person or entity that violates yours or Ohmyhome’s rights in the reviews and/or testimonials by a breach of these Terms. You acknowledge and agree that the reviews and/or testimonials you submit are non-confidential and non-proprietary.

IP INFRINGEMENT POLICY

If you believe that your IP rights have been infringed, you may send a notice of infringement to Ohmyhome (the “Notice”) at help@omh.sg, providing the following information:
your particulars, including your full name, address, telephone number, and email address such that you may be contacted about your notice;
particulars of the alleged infringer, particulars of the alleged infringing material (including a description of where it is located) and the rights which you claim has been infringed; and
a signed statement that the above information is accurate, and that Ohmyhome’s infringement agent may contact you about the Notice. In doing so, you also warrant that you are (i) the owner of the IP rights; or (ii) you are authorized by the owner (whether by obtaining the owner’s consent or by operation of law) to act on the owner’s behalf in lodging the Notice.
Ohmyhome will only accept Notices in the English language that complies with the above. Ohmyhome retains the sole discretion to take any action against such IP infringers.

CONTENT COPYRIGHT POLICY

Ohmyhome Pte Ltd respects the intellectual property rights of others and expects users of the Services to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us. If you believe that your Content has been copied in a way that constitutes copyright infringement, please provide us with the following information:
a physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
identification of the copyrighted work claimed to have been infringed;
identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material;
your contact information, including your address, telephone number, and an email address;
a statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
a statement that the information in the notification is accurate, and that you are authorized to act on behalf of the copyright owner.
We reserve the right to remove Content alleged to be infringing without prior notice, at our sole discretion, and without liability to you. In appropriate circumstances, we will also terminate a user’s account if the user is determined to be a repeat infringer. USE OF THE SERVICES

We reserve the right at all times (but will not have an obligation), to suspend or terminate users, and to reclaim usernames without liability to you. We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to
satisfy any applicable law, regulation, legal process or governmental request,
enforce the Terms of Service, including investigation of potential violations hereof,
detect, prevent, or otherwise address fraud, security or technical issues,
respond to user support requests, or
protect the rights, property or safety of Ohmyhome Pte Ltd, its users and the public.
We do not guarantee that our Services will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programs and platform in order to access our site. You should use your own virus protection software.
You may not do any of the following while accessing or using the Services:
access, tamper with, or use non-public areas of the Services, Ohmyhome Pte Ltd’s computer systems, or the technical delivery systems of Ohmyhome Pte Ltd’s providers;
probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures;
access or search or attempt to access or search the Services by any means (automated or otherwise) other than through our currently available, published interfaces that are provided by us (and only pursuant to those terms and conditions), (scraping the Services without our prior consent is expressly prohibited);
forge any TCP/IP packet header or any part of the header information in any email or posting, or in any way use the Services to send altered, deceptive or false source-identifying information; or
interfere with, or disrupt, (or attempt to do so), the access of any user, host or network, including, without limitation, sending a virus, trojan, worm, logic bomb or other material which is malicious or technologically harmful, overloading, flooding, spamming, mail-bombing the Services, or by scripting the creation of Content in such a manner as to interfere with or create an undue burden on the Services.
We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Services will cease immediately.

LINKING TO US

You may link to our Services provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link to our Services in any website that is not owned by you. We reserve the right to withdraw linking permission without notice.

THIRD-PARTY LINKS AND RESOURCES IN OUR SITE

The links from the Services may take you to other sites or services and you acknowledge and agree that Ohmyhome Pte Ltd has no responsibility for the accuracy or availability of any Information provided by third parties services and websites.
The Services may include advertisements, which may be targeted to the Content or information on the Services, queries made through the Services, or other information. The types and extent of advertising by Ohmyhome Pte Ltd on the Services are subject to change. In consideration for us granting you access to and use of the Services, you agree that Ohmyhome Pte Ltd and its third-party providers and partners may place such advertising on the Services or in connection with the display of Content or information from the Services whether submitted by you or others.
Links to other websites and services do not constitute an endorsement by us of such websites or services, or the Information, products, advertising or other materials made available by such third parties.

ADDITIONAL TERMS FOR LISTINGS

We reserve the unconditional right to approve or reject any Listing at our sole discretion without providing reasons to the Elite Member. We retain full discretion as to the publication of any Listing.
The Elite Member shall be responsible to check and endorse all contents of his or her own Listing and the accuracy and veracity of the same before it is published or repeated and the Elite Member shall be solely and fully responsible for any indirect or consequential losses to the Elite Member or any third party for such errors.
The Elite Member understands and accepts that OMH may not review the contents of any Listing. The publication of any Listing will not be deemed to constitute an acceptance by OMH that such Listing complies with the Terms.
The Elite Member represents that the contents of the Listing are true, current and accurate, and do not provide any false information or misrepresent any law or fact, or overstate or convey a false impression of any relevant information.

ADDITIONAL TERMS FOR USE OF ESTATE AGENCY WORK

Where you will be engaging Ohmyhome and/or its representatives in respect of estate agency work, you acknowledge and agree that you will be required to enter into such further prescribed forms and/or documents under the applicable legislations or laws, or as reasonably required by Ohmyhome.
